| چکیده | ||
| در آیۀ 95 سورۀ مائده حکم تحریم صید در حال احرام و کفارههای آن بیانشده است. مفسران و فقیهان در مورد برخی از احکام ذکرشده در این آیه، اختلاف کردهاند. علت این تباین دیدگاه، برداشتهای مختلف از تعابیر موجود در آیه، وجود روایات بهظاهر متعارض و همچنین دیدگاههای متفاوت در تعیینِ نقش کلمات و حروف است. این مطالعه صرفاً به موضوع «تخییر یا ترتیب داشتن حکم کفاره قتل صید در حال احرام» میپردازد و ضمن گردآوری قرائن فهم و بررسی آراء مفسران و فقیهان فریقین، تحلیلی از دیدگاههای موافق و مخالف ارائه مینماید. در ادامه نقش حرف «أو» ازنظر ادبی بررسیشده و در تبیین نقش این حرف در آیه و جایگاه حکم آن در میان سایر کفارهها میکوشد. در خاتمه نیز روایات مشعر بر نظریههای «ترتیب» و «تخییر» را مورد کاوش قرار داده و در جهت رفع تعارض ایجادشده، خوانشی نو از روایات محمول بر نظریه «ترتیب» ارائه میدهد. بر اساس شواهد بهدستآمده نگارندگان، دیدگاهی که محرم را در انتخاب کفاره مخیر میداند، پذیرفته و حکم به رعایت ترتیب را متعارض و متنافر مستندات موجود یافتهاند. | ||

| According to Sharia law, "Hunting" is one of the acts that is forbidden to Mohrem. In verse95 of Surah Ma'idah, the ruling on the prohibition of hunting in ihram and its atonement is stated. The reason for this difference of opinion is the different interpretations of the interpretations in the verse, the existence of seemingly contradictory narrations, as well as different views in determining the role of words and letters. This study deals only with the subject of "changing or arranging the expiation sentence for killing in ihram" and, while gathering evidence of understanding and examining the opinions of the commentators and jurists of the sects, provides an analysis of the pros and cons. In the end, he explores the narrations based on the theories of "sequence" and "optional" and in sequence to resolve the conflict, presents a new reading of the narrations predicted on the theory of "sequence". Based on the evidence obtained, the authors have accepted the view that the Mohrem is free to choose atonement and have found the ruling to be in conflict with the existing documents. | ||
