چکیده | ||
حق بر شادکامی از جمله حقوق طبیعی انسان است. از آنجا بخش مهمی از حق بر سعادت، شادکامی و کمال انسان زمانی محقق میشود که فرد از تمامیت و سلامت قوای جسمی و روحی لازم برخوردار باشد، بنابراین حقوق طبیعی هیچکس نمیتواند نادیده انگاشته یا منبع و منشأ آن معدوم شود. بیان بالا فرضیۀ اصلی نوشتار حاضر است. از این جهت مفروض ما این خواهد بود که حقوق طبیعی هر انسانی بنیان طبیعی سعادت و شادکامی او را فراهم آورده است و خلل در این حقوق از طریق تجاوز به حقوق او یا سد موقت استفاده از آن یا ایجاد آسیب دائمی به منبع تغذیۀ آن که درون آدمی به شکل قوانین طبعی، فطری و غریزی وجود دارد، منجر به لزوم جبران مضاعف میشود. در برخی شرایط چون وضعیت اخیر، دولت به نمایندگی از جامعه باید از طریق تبعیض مثبت به تدارک مادامالعمر ضرر در حقوق طبیعی قربانی بپردازد. درنظرگرفتن این امتیاز خاص برای آنان که به خاطر سعادت عمومی ایثار کردهاند از دو طریق حقوق بشر و حقوق شهروندی قابل اثبات است. این مقاله با محوریت مجاهدان و ایثارگران در جنگ ایران-عراق تدوین شده است. | ||
