چکیده
یکی از موضوعات مهم اساسنامۀ دیوان بین‌المللی کیفری، صلاحیت دیوان است که از زمـان مذاکرات کنفرانس رم تاکنون مورد چالش و موجب مباحث فراوانی بوده است که می‌توان به بحـث شروط اعمـال صلاحیت دیوان و خلأهای صلاحیتی آن در مواجهه با جنایات بین‌المللی موضوع اساسنامه اشاره کرد. امکان بسط صلاحیت دیوان نسبت به اتباع دولت‌های غیرعضو همواره از سوی موافقان صلاحیت فراگیر دیوان مطرح شده است و تلاش می‌شود با تفسیر موسع از شروط اعمال صلاحیت دیوان چنین قابلیتی به نهاد مزبور اعطا کنند. نوشتۀ حاضر با بررسی نظرهای موافقان و مخالفان این موضوع، به روش توصیفی-تحلیلی درصدد پاسخگویی به این پرسش است که اصولاً در چارچوب اصول حقوق بین‌الملل، دیوان می‌تواند نسبت به اتباع دول غیرعضو اعمال صلاحیت کند یا خیر. براساس یافته‌های این پژوهش نه‌تنها قواعد حقوق بین‌الملل این اجازه را نمی‌دهد، بلکه نظم هنجاری جامعۀ بین‌المللی نیز تاب چنین تحولی را ندارد.
