چکیده | ||
درحالیکه امروزه بهصورت گسترده پذیرفته شده است که گروههای مسلح سازمانیافته ملزم به رعایت و اجرای حقوق بشردوستانهاند، با این حال با توجه به ماهیت دولتمحور حقوق بینالملل و همچنین عدم صلاحیت گروههای مسلح سازمانیافته به تصویب و الحاق به اسناد بینالمللی، چگونگی و بهعبارت دیگر مبنای حقوقی الزام گروههای مسلح سازمانیافته به رعایت و اجرای حقوق بشردوستانه مبهم است. نویسندگان حقوقی و محاکم بینالمللی بهمنظور تعیین مبنای الزام گروههای مسلح سازمانیافته به رعایت و اجرای حقوق بشردوستانه استدلالها و نظرهای مختلفی را ارائه دادهاند. این استدلالها عبارتاند از: عرف بینالمللی، اصول کلی حقوقی، رضایت گروههای مسلح سازمانیافته، نظریۀ جانشینی و نظریۀ صلاحیت قانونگذاری. باید توجه داشت که این موضوع صرفاً بحث آکادمیک نیست، بلکه زمانیکه محاکم بینالمللی کیفری درصدد اجرای اصل قانونی بودن جرم و مجازات هستند، این بحث اهمیت زیادی پیدا میکند. در این مقاله ضمن بررسی این استدلالها، با توجه به نقصها و ایرادات دیگر استدلالها، به این نتیجه میرسیم که نظریۀ صلاحیت قانونگذاری، استدلال مناسبی بهمنظور ملزم ساختن گروههای مسلح سازمانیافته به رعایت و اجرای حقوق بشردوستانه است. | ||
