چکیده
تنظیم روابط کارگر و کارفرما از مهم‌ترین و تأثیرگذارترین اقدامات دولت‌ها در عرصۀ اجتماعی، اقتصادی و فرهنگی هر کشوری است. اهمیت این بحث به تفاوت جایگاه دو قشر کارگر و کارفرما در جامعه، تعداد بالای افراد درگیر و تأثیرگذاری عمیق آن‌ها در اقتصاد کشورها باز می‌گردد. بدیهی است اگر در مسیر رابطۀ میان کارگر و کارفرما اختلالی به‌وجود آید، باید ساز‌و‌کاری قانونی پیش‌بینی شود تا اختلافات را برطرف کرده، حرکت این دو قشر را در کنار هم تداوم بخشد. مراجع حل اختلاف کار و نظام دادرسی مربوط به آن‌ها، راه‌حل قانون‌گذاران است. بااینکه چنین ساختاری در جوامع مختلف بر مبنای اصول مشخصی طراحی شده است، اما تفاوت‌های مهمی دارند که بر کارایی این سیستم‌ها تأثیرگذارند. در این مقاله، نظام دادرسی کار در چند کشور اروپایی را بر مبنای چهار محورِ استقلال مراجع رسیدگی کار، صلاحیت این مراجع، ساز‌وکار پیش‌بینی‌شده برای مصالحۀ میان طرفین پیش از ورود به مرجع رسیدگی، و نیز تعداد و کیفیت قضات کار به لحاظ آشنایی با دانش حقوق و مسائل تخصصی و صنفی، بررسی نموده، با دقت در اسناد بین‌المللی، وجود یا امکان‌سنجی وجود نکات مثبتی را که در این پژوهش به آن‌ها رسیده‌ایم، برای ساختار دادرسی کار در ایران بررسی می‌نماییم.
One of the most important and effective measures of governments in social, economic and cultural fields is the regulation of relationships between laborers and employers. Different position of laborers and employers, the large number of people engaged in this relationship and their considerable influence over each country’s economy shows the importance of this issue. Therefore, it is apparent any dispute over employment relationships should quickly be heared through labor dispute settlement boards. Although the structure of these institutions in different countries has been affected by specific international standards, there are wide disparities among them which have serious effects on their efficiency. In this essay, we tend to state the Structure of Labour Dispute Settlement boards in Iran and some European countries from four perspectives: independency, competence, pre-trial stage and quality of judges. We also explain the relevant international documents in order to find their remarkable features which we can implement in the Iranian legal system.
