| چکیده | ||
| پیشرفت فزایندة فناوریهای هوش مصنوعی، بهویژه سامانههای خودمختار، مفاهیم سنتی مسئولیت مدنی را دگرگون ساخته و پرسشهای بنیادین دربارة انتساب تقصیر در غیاب ارادة انسانی پدید آورده است. اعطای «شخصیت حقوقی الکترونیکی» به هوش مصنوعی با مبانی انسانمحور فقه امامیه و حقوق ایران ناسازگار است. پژوهش حاضر با روش توصیفیـ تحلیلی، پس از نقد و رد امکان اعطای شخصیت حقوقی مستقل به هوش مصنوعی، الگوی بومی «مسئولیت مطلق تضامنی» میان تولیدکننده و بهرهبردار، همراه بیمة اجباری و صندوق مشترک ریسک، را به عنوان راهکاری واقعگرایانه و کاملاً سازگار با قواعد ضمان، تسبیب، و لاضرر پیشنهاد میکند. هوش مصنوعی فاقد قصد، تمییز، و اهلیت لازم برای شخصیت حقوقی است. بنابراین مسئولیت باید بر پایة بهرهمندی از منافع و تسلط بر منبع خطر به تولیدکننده و بهرهبردار منتسب شود. این مدل ضمن تضمین حمایت مؤثر از زیاندیدگان و رفع خلأ موجود در قراردادهای هوشمند (مادة ۱۸ قانون تجارت الکترونیک)، بدون نیاز به شخصیت الکترونیکی، اعتماد حقوقی به فناوریهای نوین را تقویت میکند. بدینسان، پیشنهاد حاضر گامی عملی در جهت تقنین هوش مصنوعی و حفظ تعادل میان توسعة فناورانه و مبانی پایدار فقه امامیه است. | ||
