چکیده
تولید انرژی تجدیدپذیر دریایی از طریق فناوری‏ های جدید، به‏خصوص استفاده از توربین ‏های بادی فراساحلی، صنعت جدید در حال رشدی است که به‏ دلیل ایفای نقش مؤثر در مبارزه با تغییرات اقلیمی و مزایای تولید انرژی در دریا، در آینده نه ‏چندان دور در آب‏ های خلیج ‏فارس مستقر خواهد شد. با این حال، تولید انرژی تجدیدپذیر دریایی می‏ تواند تأثیرات زیست‏م حیطی منفی داشته باشد، زیرا نصب، نگهداری، بهره ‏برداری و برچیده‏ سازی فناوری‏ های مزبور و همچنین انتقال انرژی به شبکه، می ‏تواند حفاظت از محیط ‏زیست دریایی را با مخاطرات جدی رو به ‏رو کند. ازاین‏ رو توجه به حفاظت از محیط ‏زیست و پایداری توسعه انرژی تجدیدپذیر دریایی در مناطق دریایی تحت حاکمیت یا صلاحیت دولت‏ های حاشیۀ خلیج ‏فارس ضروری است. این نوشتار، اسناد کلیدی حقوق دریاها در مورد حفاظت از محیط ‏زیست دریایی را در برابر تأثیرات تولید انرژی تجدیدپذیر دریایی در خلیج ‏فارس بررسی می‏کند. این بررسی نشان می‏ دهد که چارچوب فعلی نظام حقوق دریاها، از نظر تئوری قادر به حمایت حداقلی از محیط ‏زیست دریایی در برابر تأثیرات تولید انرژی تجدیدپذیر دریایی است، اما برای تضمین حفاظت کامل از محیط زیست دریایی، به توسعۀ بیشتری نیاز دارد. با این حال، خلأ مزبور، نقش مهم ایجاد و به‏ روزرسانی قوانین در سطح بین ‏المللی، منطقه ‏ای و ملی را نیز برجسته می‏ کند.
