در مسائل متعددی از فقه، خصوصاً در بحث از قاعدة «ما یُضمن بصحیحه یُضمن بفاسده» سخن از ضمان ناشی از عقد صحیح به میان آمده است. اگر در کنار این مطلب به سخن برخی از فقها در مورد وحدت معنای ضمان در تمام موارد توجه شود، مسئلة مفهوم و مبنای ضمان در عقد صحیح مطرح خواهد شد. از لحاظ مفهوم ضمان میتوان برای عقد صحیح سه مرحلة تشکیل، تلف عوضین قبل از تسلیم و فسخ یا انفساخ عقد پس از تسلیم را در نظر گرفت. مقصود اصلی این نوشته، بررسی مفهوم ضمان در مرحلة تشکیل است و بهناچار، از مراحل دیگر نیز سخن گفته میشود. در مورد ضمان در مرحلة اول، رویکردهای متفاوتی در بین نظر فقها وجود دارد: برخی از فقها مفهوم ضمان در عقد صحیح را انکار کردهاند، برخی به وجود ضمان معاوضی معتقد بودهاند و گروه سوم، عقد صحیح را بهگونهای تفسیر کردهاند که متضمن ضمان قهری و به تعبیری، از اسباب ضمان قهری است. اقدام، استیفا، احترام و ضمان ید چهار نظریة اصلی هستند که ماهیت عقد در قالب آنها توجیه شده است. مباحث این تحقیق عمدتاً ناظر به بررسی مفهوم ضمان در بخش اول قاعدة «ما یضمن» در عقد بیع خواهد بود، اما میتوان آنها را با تعدیل مناسب، به سایر عقود معاوضی نیز سرایت داد.
Responsibility for Valid contracts in the Jurisprudential Thought

In various subjects of Islamic jurisprudence, especially in the maxim “any contract in which there is responsibility for its valid one, there is responsibility for its void one”, the responsibility for valid contracts has been discussed by Islamic jurists. As regards the notion of responsibility, three stages could be regarded for a valid contract: formation, perish of considerations before delivery, and perish of considerations after termination. The main concern of this article is with the first stage although the other two stages are studied too. As to responsibility in this stage, there could be seen various attitudes among Islamic jurists: some ignore the notion of responsibility in valid contracts, some believe in contractual responsibility, and others interpret a valid contract so as to include non-contractual responsibility.
This article deals with responsibility in a valid contract of sale; however, the discussions may be extended to other valid contracts with some appropriate modifications.
